Summary of Texas Legal Wills

This article will walk through Texas Legal Wills by covering important aspects of TX Wills, Texas Probate, Online Wills, why they are an important part of your Texas Estate Planning process. A will is a legal document that outlines the wishes of the person writing it with regards to distributing their property and who will raise their children after their death. With out a will, state law determines who will get your property and this can mean distribution counter to your wishes. Without a will you can also end up with a judge deciding who will raise your children. Creating a Will is one of the most important things you can do to.

How Texas Legal Wills Deal with Property

There are two types of property in Texas; Real Property and Personal Property. Real property is land and improvements located on the land, and oil, gas and mineral rights. Personal property is all property other than real property including cash and bank accounts, household furnishing, motor vehicles, stocks and bonds, life insurance policies and government, retirement or employee benefits.

There are two classes of property ownership in Texas; separate and community. Separate property is property that is owned prior to marriage or acquired during marriage as a gift or inheritance. Community property is all other property that is acquired during marriage by either spouse.

Dying without a Legal Will in Texas

A person that has not created a will prior to death is said to be intestate. In Texas, if a person dies without a will the law disposes all of the property based upon Texas law and not based upon the wishes of the deceased person. Dying without a will can also delay the disposal of property because a legal proceeding might be required to establish who the heirs are and an administrator may need to be assigned. The administrator may also be required to post a bond to ensure the duties are appropriately performed.

The Advantages of Having a Texas Legal Will

Having a Will is all about having control of how your property and family are handled after your death. A will is a legal document that outlines the wishes of the person writing it with regards to distributing their property and who will raise their children after their death. Having a valid will helps eliminate the problems of dying without a will. The testator can name the recipients of their property and designate the individual that will manage their property and care for their minor children.

The Requirements for Creating a Will

If you are planning on writing your own will, its creation requires specific rules to be followed for the will to be valid. There are three kinds of wills recognized in Texas:

Oral (there are limitations associated with oral wills)

Handwritten (also called Holographic)

Type written (also called Formal)

The testator must meet the following requirements:

Be at least 18 years old, married or serving in the armed forces

Be of sound mind at the time of executing the will

Not be forced or deceived to make the will

Have the intent to pass on property at time of death

There are enough complications and requirements that it is wise to seek out legal help in preparing Wills in Texas to ensure it is valid. In addition to a will there are other elements you may want to consider including Trusts and Living Wills (see below).

Are you going to be giving some money or property to someone when you pass away? Inheritance tax planning can be very tricky and there are several things that you will need to know in order to make sure that your loved ones are protected when you are gone. Nobody wants to leave this Earth not knowing what is going to happen to the things that we own when we are gone. After all, you have worked hard all of your life to have all of the personal belongings and money that you have, and you should be the one who decides where all of that stuff goes. If you do not know how to go about sorting everything out that you want to leave to your loved ones then you may want to get some inheritance tax planning advise. There are a few things that you will want to be aware of and discuss with an inheritance planner.

One thing that you will want to be aware of is the difference between the properties that you own. There are two different types of property that you will have to deal with when you are doing inheritance tax planning UK. The first type of property is called real property and includes any land and improvements made on that land by human beings. This includes any oil, gas, or mineral deposits that you may have rights to on your land. This also includes buildings, machinery, and other immovable objects that are placed on the land and have become a part of the land. Personal property is anything that is not real property. Any cash, stock, bonds, or other monetary objects that you may have are also considered as personal property. You must know the difference between these two types of property because they will be part of your inheritance tax planning and each will be taxed differently.

There are several ways that you will be able to cut down or even cut out the amount of taxes that your loved ones have to pay on the items that you leave to them. For instance, you can give a certain amount of money as a gift to people every year. There are also other things that you can do in order to get deductions on your taxes and to help deduct the amount of money that your loved ones will have to pay.

There are several different aspects of inheritance tax planning that you will want to get advise about so that you will not have to worry about your loved ones when you are no longer here to take care of them. You will want to make sure to take care of all of the planning that needs to be done well ahead of time. You do not want to have to risk an accident happening and your life being ended before you have time to plan out where your property is going to go and how much money the taxes will be.

There are multiple types of Wills that are valid in Texas.

Written– This is a standard will that has been typed up and is most often created by a professional. Written wills are also called Formal Wills. It must be signed by the testator, be witnessed by 2 credible witnesses above the age of 14 and signed by the witnesses. A beneficiary of the formal will should not be one of the witnesses to the will.

Handwritten – A hand written will is also referred to as a holographic will. A hand written will must be written entirely in the handwriting of the testator (type written words can’t be included). The will must be signed by the testator. It doesn’t need to be witnessed and it can be written on anything.

Oral Will –An oral will is valid only for personal property and it is only valid if made by the testator if they are in their last illness at home or if they can’t return to home. Real property can not be passed through an oral will (ex: real estate). If the value of the personal property is more than $30, there must be at least 3 witnesses to the oral will.

The testator requirements for types of Texas Wills are that:

The testator is at least 18 year old, married or serving in the armed forces.

Be of sound mind at the time of executing the will

Not be forced or deceived to make the will

Have the intention to distribute property upon their death

The best will is one that was prepared with the help of an attorney. Laymen created formal wills are better than handwritten wills and both are preferable to oral wills.

Video wills are another type of will. These have become more popular since the technology to easily make them has become available. In and of themselves, video wills aren’t usually sufficient to create a legal will and they are usually accompanied by a written will. Video wills that have the testator reading them can help demonstrate intent and sound mind at the time of the reading.

Do It Yourself Wills

We are going to discuss why it is important to have a will, the pros and cons of writing your own will and outline the beginning steps to Do It Yourself Wills.

Why a Will is Important

Wills give explicit legal instructions about your intentions. Even people with modest means should have a will and it is critical for parents of young children to have a valid will. Without a will, your property will be distributed according to the probate law of your state and while the probate codes are reasonable for most cases, they can direct assets counter to your wishes.

The Advantages of Writing Your Own Will

The biggest advantages to writing your own will is that you can complete one quickly and you can save yourself money by going down the do it yourself will route. Writing your own will can be a quick and straight forward process if you have a fairly simple scenario. There are also many resources that you can use to help you write your own will. See the Resources section below for more on creating a last will and testament.

The Disadvantages of Writing Your Own Will

The biggest con to writing your own will is that you can screw it up and it won’t be judged a valid will. In that case it probate court takes over as if you didn’t even have a will. If you have dependent children or complicated assets (like a business or trusts) the complications associated with writing your own will make the risks of getting it wrong outweigh the rewards of saving money. Using an attorney to create a will usually doesn’t cost a lot of money and you will end up with a will that you know will be valid. An attorney will also be able to suggest other forms of asset distribution that could save huge amounts of money or hardship.

The steps to writing your own will

Find a couple of credible references for your particular state. Probate law varies significantly from state to state. Don’t fall into the trap of using generic will forms or ones for a state other than the one you reside in. Good resources include books and online resources like your state’s bar association web site.

Create an inventory of your assets

Determine what you’d like to happen with each asset upon your death

Choose an executor. The executor is the person that will carry out the directions left in your will. Make sure the person you choose will have the time and skill necessary AND the willingness to do the job.

Write your will.

Have your will signed by two witnesses. Verify the requirement of your particular state.

Writing Your Own Living Will

Learning how to write a living will is more challenging than learning how to write a will yourself. Creating a living will is a more specialized task, fewer people do it by themselves and so there are fewer resources available to help you in the process. If you have your heart set on creating a living will for yourself, I recommend that you get it reviewed by a professional before calling it done. There are extra complications and challenges in creating a living will and it is easy to make mistakes.

Resources To Help You Write a Legal Will

There are many resources available that will make it easier when you are writing a will. Again I want to emphasize that every state has different probate codes so you must get up to date and state specific information if you want to learn how to write a will in Texas, or any other state, the right way.

First off there are MANY books that will teach you how to write a will. Some of the best are the ones that walk you through the process in small simple steps and before you know it you will be done with creating a will that will that will both stand up in probate court and represent your personal wishes. Two book recommendations: NOLO’s Quick & Legal Will Book or NOLO’s Simple Will Book, both by Attorney Denis Clifford.

If you prefer a little more interactive medium, there are a couple of very good “write a will” software programs on the market. A good choice for creating wills with software is Quicken’s WillMaker Plus. There are also online services that help you write a last will and testament. Some are simple questionnaire systems and others like LegalZoom also have a legal expert review your answers.

When you hear the word tax attorney what is the first thing that pops into your head? Most people probably think unpleasant thoughts, but dealing with the IRS is not the only reason that someone goes to see a San Antonio tax attorney. In a lot of cases the job of a tax attorney is to save their clients money on their taxes or to give legal advice when someone is starting a business. If you are unfamiliar with the tax laws in Texas then it will be necessary for you to consult a tax attorney so that you can get the help that you need. There are a lot of San Antonio tax attorneys who are qualified to help you when it comes saving you money or dealing with matters involving the Internal Revenue Service. If you ever find yourself in need of a tax attorney there are some things that you should be familiar with.

If you are an individual who has to fill out tax forms and file for a return or file a payment form then there are a few things that you will be interested in. Anyone can help you to fill out your tax return forms, but only a relative or a San Antonio tax lawyer will be able to argue your case in front of an administrative tax court if a mistake is made. If you do not have a relative that is a lawyer then it is highly recommended that you seek the council of San Antonio tax lawyers.

A tax lawyer is someone who has gone to school to learn the different tax codes and laws and who has a license to practice law. Sometimes you will find that someone who has gone to law school may also have another type of degree such as business or accounting. These are the ones that can be very beneficial to you if you own a small business and need help with tax issues. This means that the lawyer will be familiar with more than just the law about taxes and will be able to help you with other questions that you may have about your business.

If you are looking for a tax attorney in San Antonio then you will want to make sure that you get someone who is qualified to help you with your case. You want to make sure that the lawyer has a degree and has a license to practice law. If you find that the price they are asking seems too low then you will want to do some additional research. You may find yourself paying for advice and will not have anyone to stand by your side if you ever have to go in front of an administrative tax court if you hire someone who does not have a license. Whether you want to prevent a tax penalty from happening or one already has and you need help with it you will be able to find a San Antonio tax attorney to help you with your issue.

Are you ready to start planning for where you assets are going to go when you are no longer around? Austin estate planning is one of the most important things that you can ever do in your life. Nobody wants to go to their grave not knowing to the ones that they are leaving behind. If you have done well with your life and you want to give your belongings away when you pass on then you will need to become familiar with what all is involved in Austin Texas estate planning. There are a lot of legal details that need to be cleared up and a lot of matters that you will need to clear up, so you will want to know where to start and have a basic understanding of how the planning works before you get started.

One of the first things that you will do when you are doing estate planning in Austin Texas is make out a will. A will is a legally binding document that will decide where your assets are going to end up when you die. You will also put important matters down such as who is going to raise your children if they are still minors when you pass away. If you do not make any decisions regarding these two matters then the state law and the court will decide for you when you are no longer around. If you do not want for the court to decide then making out a will is the only way that you will be able to make the decision.

When you sit down to draft your will there will be several legal terms that you will most likely be unfamiliar with. You will want to learn what these legal terms mean before you sign any important documents so that you do not commit to something that you do not agree with. If you have a lawyer that is helping you with this issue then you will want to discuss anything with them that you do not understand.

When you are doing estate planning Austin then you will want to know about the tax laws of Texas so that you will know who is going to be responsible for paying the estate taxes when you have passed away. Estate tax is tax that is imposed on the assets that you divide amongst your heirs in your will. There are some things that are taxable and there are some items such as gifts that are not taxable. If you do not know what these items are then you will want to consult your attorney to find out.

There is a lot of work that has to be done in Austin financial planning. If you do not want to leave this world without knowing that your loved ones are taken care of then the only sure way is to sit down and plan out your estate. When doing Austin estate planning you make all of the decisions about your belongings so that the court will not be able to. When in doubt, find one of the many reputable Austin Attorneys to help you in this process.
